Barrelshoppe.com (hereinafter the “Website” or “Site”) is an online store owned and operated by Barrel Shoppe, LLC (hereinafter “Barrel Shoppe”, “we”, “our” or “us”). Barrel Shoppe reserves the right, at its sole and absolute discretion, to revise these terms and conditions at any time, noting the “Last Updated” information provided above, and in some cases, Barrel Shoppe may provide you with additional notice (such as sending you an email). By accessing or using the Site, you the end user of our services and, in some cases, Barrel Shoppe may provide you with additional notice (such as sending you an email). (the “Purchaser”, “User”, “You”, or “your”), expressly agree to be bound to and to abide by our sales and shipping policies (“Shipping Policy”) our Terms of Service, Privacy Policy and our Return and Exchange Policy, and any other policy we may develop from time to time (collectively, the “Policies”), which create legal and enforceable agreements whether or not you register for an account with us, or whether or not you attempt a transaction with us or actually engage in a transaction with us. If you do not agree to be bound by the terms of our Shipping Policy or any of our other Policies, do not attempt to engage in a transaction with us.

All captions, titles or section headings of these terms and conditions are for ease of reference only and shall not affect the interpretation or construction of any provisions herein. Wherever the word “including” or “include” shall appear, such term shall be construed to mean “including without limitation” or “include without limitation,” as the case may be.

OUR WAREHOUSE IS LOCATED IN NORTHERN CALIFORNIA. NON-CALIFORNIA RESIDENTS ACCEPT ALL RESPONSIBILITY FOR DETERMINING IF THEIR STATE OR LOCAL LAWS ALLOW ALCOHOL PRODUCTS TO BE SHIPPED TO THEIR STATE OR COUNTY. 

• We do not ship outside the U.S.
  
• The United States Postal Service (“USPS”) prohibits the sending of intoxicating liquors having 0.5 percent (0.5%) or more alcoholic content are nonmailable through USPS. Taxable liquors (as defined by Chapter 51, Internal Revenue Service Code) with 3.2 percent (3.2%) or less alcohol, including those obtained under a prescription or as a collector’s item, also are nonmailable. The prohibition of the mailing of intoxicating liquors is contained in federal law (18 U.S.C. 1716).
  
  • Consequently, Barrel Shoppe will not arrange for any carrier to deliver to a P.O. box under any circumstances.

Warning: Certain states expressly prohibit the direct importation of alcohol and violation can be punishable as a misdemeanor or felony. Please contact your local alcoholic beverage control agency or the receiving jurisdictions equivalent for further information. In addition, other restrictions may apply as some states limit the quantity and type of products that may be shipped to an individual address. We are not able to provide any legal advice.

BARREL SHOPPE AND BARREL SHOPPE AFFILIATES MAKE NO CLAIM IN REGARDS TO THE RIGHTS OF USERS TO RECEIVE SHIPMENTS INTO THEIR STATE OR JURISDICTION. IF YOU ARE IN DOUBT ON THIS MATTER, PLEASE CONTACT YOUR LOCAL GOVERNING BUREAU OR AGENCY BEFORE ORDERING. VOID WHERE PROHIBITED BY LAW.

Age Verification and 21+ Year Old Signature Required upon Delivery. You must be at least 21 years of age to place an order with us, and the signature of someone at least 21 years of age is required upon delivery.

Barrel Shoppe reserves the right to ask for proof of identity before allowing you access to the Website or allowing you to purchase a Product(s).

By placing an order you verify that you and/ or any order recipients are at least twenty-one (21) years of age. At the time of delivery you and/or the order recipient must sign an age verification receipt stating that they are at least twenty-one (21) years of age and must present a valid driver’s license, military ID, passport or State ID for identification. All shipments must be signed for.

According to shipping carrier policies, if there is not an individual at least twenty-one (21) years of age present to sign for the package, and three (3) unsuccessful delivery attempts have been made at the recipient's address, the package will be returned to the shipper. 

Title to Goods. Laws concerning the sale and shipping of alcoholic beverages are complex and vary from state to state, and in some cases vary from county to county and could be prohibited in a particular town or municipality.  Accordingly, you understand that you will be the legal owner of the product(s) that you purchase from immediately upon receipt of proper authorization and processing of your payment method, and any holds have been cleared.  Title to all alcoholic beverages purchased on this Site pass to you in the State of California when the goods are picked up by the common carrier. 

Shipping Laws. You are responsible for abiding by all state and local laws, rules, and regulations of your state pertaining to the receipt of alcoholic beverages from out of state.  You additionally represent you have obtained any required permission, paid any required fees, are working through properly licensed intermediaries where required, and that the receiver of the package containing your order Is legally entitled to receive and take possession of the delivery of the package. You further represent you are legally entitled to take possession of the quantities of alcoholic beverages ordered, and that you and the person accepting delivery of the alcoholic beverages are at least 21 years of age, for clarity, both the Purchaser and the intended recipient must be at least 21 years of age.

Appointment of Common Carrier. By making a purchase on our Site, you are asking us to appoint a common carrier and arrange for transportation on your behalf for the delivery of alcoholic beverages and any other purchased merchandise to you.  By making use of this service from Barrel Shoppe, you are representing you are acting in compliance with your local and state laws regarding the purchase, transportation, and delivery of alcoholic beverages. Accordingly, we make no representations or warranties concerning the legal requirements of shipping alcoholic beverages to your state; our Site merely provides a list of those states where common carriers have indicated their willingness to deliver alcohol.  As such, you understand and acknowledge you are accountable and liable for compliance with all laws concerning such shipments to the state of delivery.

Purchaser’s Indemnification of Barrel Shoppe for Arrangement of Shipping Services on Purchaser’s Behalf. Consequent to our acting as your agent for purposes of securing a common carrier on your behalf, Purchaser agrees and understands that Purchaser shall indemnify, defend and hold harmless, Barrel Shoppe and our parent, subsidiaries, affiliates, partners, members, shareholders, managers, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, from any and all claims, demands, damages, liability whatsoever, whether in tort, contract, or otherwise, arising out of or relating to the arranging, securing, or facilitating, the shipment of alcoholic beverages on Seller’s behalf, including any and all claims that such shipment may violate any federal, state, or local regulation pertaining to the sale and shipment of alcoholic beverages.

Changes in Shipping Laws. Following the placement of any order, and prior to the goods being shipped, in the event the laws of your state change so as to make it illegal for you to import alcoholic beverages into your state, you may request a return of your order for a full refund, provided however, you have submitted proof to Barrel Shoppe, and its counsel, of regulations pertaining to such law changes.  Keep in mind the mailing of intoxicating liquors of any kind through USPS is prohibited. Once an order has been transferred to a carrier for shipping, we can no longer accept transfer of title of the purchased goods. 

Shipment Charges, Method, Timing and Delivery. 

• Shipping charges are calculated based on weight, destination, and delivery method. 
  
• The goods you purchase from us will be shipped from the State of California, where our warehouse is located. While Barrel Shoppe tries to make every effort to fulfill orders at a reasonable speed, all orders placed Monday through Friday will be shipped out within 1-9 business days.
• All Ground shipments placed Monday through Friday before 4pm PST will be shipped out within 1-9 business days (Shipments placed during the holiday season may take longer to process). If the product is not currently in stock delivery will be delayed.
  
• All Express shipments placed Monday through Friday before 4pm PST will be shipped out the following business day (Shipments placed during the holiday season may take longer to process). If the product is not currently in stock delivery will be delayed.
  
• Orders placed on Friday after business hours, Saturday or Sunday will be shipped out within 1-9 business days from the following Monday.
  
  •  All goods must be signed for by an adult over the age of 21 for release of Delivery.    Deliveries will not be left at any address or with any individual without such signature.  You are responsible for checking your order immediately upon delivery.  Items must be reported as missing or incorrect within three (3) business days from the date of delivery.
  • In the event an incorrect product was shipped, you must submit a photo of the sealed bottle along with your order number in an email to Barrel Shoppe. If you are not contacted by us for any reason within 14 days of your email, please send another email from a different email address if possible. Please see the Return and Exchange Policy for more details on this situation. 

Address Change Requests. If you need to change the shipping address after placing an order, please make the request promptly. We will make a good faith effort to accommodate the request, but there is no guarantee that the address change can be accomplished. Any fees or costs associated with an address change request will be passed on to the Purchaser.

No Insurance. Barrel Shoppe does not offer insurance for any orders at this time.

• Damage in Transit and Lost Packages. 
  
  • While Barrel Shoppe takes every precaution to ensure your order is packaged properly and arrives safely, spillage, minor damage and/or cosmetic defects, catastrophic damage resulting in nearly complete loss of value, or a total loss of value are all possible to occur during shipping. Purchaser agrees and understands that Barrel Shoppe is not responsible for any such damages or loss, and Purchaser agrees and understands that any loss or damages incurred that occurs after the package/goods are transferred to the carrier shall be between Purchaser and the designated carrier.
  • Purchaser agrees and understands that Barrel Shoppe is not responsible for any lost shipments, including but not limited to: packages lost because of hold requests, delivery rescheduling, or lost during return shipping to Barrel Shoppe due to failed delivery to Purchaser as determined by the carrier.

• Failed Deliveries Returned to Barrel Shoppe.
  
  • If the package is returned due to failed delivery or deemed by the carrier as undeliverable for any reason whatsoever, including an individual attempting to sign for the package while under the age of 21, a twenty-five percent (25%) restocking fee will be deducted from your refund. Shipping costs will not be refunded.
    
    • Note: If an order that was shipped free of charge or with discounted shipping for any reason whatsoever, we will deduct forty dollars ($40.00) from the refund for shipping and handling.
      
  • If the package is returned to Barrel Shoppe due to failed delivery or deemed undeliverable by the carrier for any reason whatsoever, and any product is not received in new, undamaged, resalable condition (i.e., no damage to product labeling or retail packaging as applicable), the determination of which is at our sole discretion, then no refund shall be issued to you. 

• Limitation of Liability. BARREL SHOPPE WILL NOT BE LIABLE UNDER ANY LEGAL THEORY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE, ANY ATTEMPT TO ORDER ANY OF THE GOODS THAT WE SELL, OR ANY ACTUAL TRANSACTION THAT YOU ENTER INTO WITH US, REGARDLESS OF WHETHER BARREL SHOPPE HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. BARREL SHOPPE RESERVES THE RIGHT TO CHANGE ANY INFORMATION CONTAINED ON THE SITE AT ANY TIME AT ITS SOLE AND ABSOLUTE DISCRETION. IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS OF THIS WEBSITE, OR ANY CONTENT CONTAINED THEREIN, DO NOT USE THIS WEBSITE AND DO NOT PURCHASE ANY GOODS FROM US. YOUR SOLE AND EXCLUSIVE REMEDY AGAINST BARREL SHOPPE IS TO DISCONTINUE USE OF THE SITE AND DAMAGES AGAINST BARREL SHOPPE SHALL BE LIMITED TO THE DOLLAR VALUE OF THE ORDER PLACED BY YOU.

• Disclaimer of Warranties. EVERY EFFORT HAS BEEN MADE TO MAINTAIN THE ACCURACY OF THIS WEBSITE. HOWEVER, INADVERTENT FACTUAL OR TYPOGRAPHICAL ERRORS MAY EXIST.  BARREL SHOPPE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY SUCH ERRORS OR OMMISSIONS IN ANY OF THE INFORMATION CONTAINED ON THIS SITE. ACCORDINGLY, AND WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE INFOMRATION CONTAINED ON OUR SITE OR IN ANY OF OUR POLICIES, IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND WHATSOEVER, EITHE EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR INTENDED USE. 

• Assumption of the Risk. USER EXPRESSLY AGREES THAT THE DECISION TO PURCHASE AND REQUEST THAT WE APPOINT A SHIPPING CARRIER ON USER’S BEHALF IS AT USER’S SOLE RISK. THE INFORMATION CONTAINED ON THIS SITE OR IN OUR POLICIES ARE NOT TO BE CONSTRUED AS LEGAL, TAX OR OTHER PROFESSIONAL ADVICE. OUR SERVICES ARE A RESOURCE ONLY. WE ARE NOT ATTORNEYS, PARALEGALS, ACCOUNTANTS, OR TAX SPECIALISTS, OR ANY OTHER SORT OF LICENSED PROFESSIONAL. AS SUCH, WE EXPRESSLY DISCLAIM ALL LIABILITY RELATED TO THE ACCURACY OR RELIABILITY OF ANY OPINION, GUIDANCE, OR CONTENT TRANSMITTED BY US OR AVAILABLE THROUGH OUR SITE OR SERVICES OR RELIANCE ON ANY OF THE AFOREMENTIONED. • Force Majeure. We will not be deemed to be in default of or to have breached any provision herein as a result of any delay, failure in performance or interruption of service, resulting from acts of God, acts of civil or military authorities, civil disturbances, wars, strikes or other labor disputes, pandemic, epidemic, fires or other catastrophes or occurrences which are beyond Barrel Shoppe’s reasonable control. 

• Severability. If any of these terms and conditions (or any portion thereof) or the application of any such provision (or any portion thereof) to any person or circumstance shall be held invalid, illegal or unenforceable in any respect by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision hereof (or the remaining portion thereof) or the application of such provision to any other persons or circumstances, and the parties shall endeavor to fulfill the intent of the severed provision to the extent permitted by law.

• Headings and Interpretation. All headings, titles, or captions in this Shipping Policy or any of our the Polices, are provided for convenience only and do not affect the interpretation or construction of any provisions contained herein. The terms "including" or "include" should be understood to mean "including without limitation" or "include without limitation," as appropriate. No provision of this Shipping Policy or any of our Policies shall be construed by any court or other judicial authority against any party hereto by reason of such party's being deemed to have drafted or structured such provisions.

• Exclusive Jurisdiction and Venue. You agree that any and all disputes between Barrel Shoppe arising under or related to any transaction between the parties, the Shipping Policy or our other Policies shall be governed exclusively by the laws of the State of California and of the United States of America, without regard to conflicts of law principles and such suit, action or proceeding shall be brought exclusively in the Courts of the State of California  in Contra Costa County, California or in the United States District Court for the Northern District of California.
